4Form AI Terms of Service

1. Agreement

These Terms are between you and Tyson Youm and Oscar Chuang ("4Form AI", "we", "us"). By creating an account or using the app, you accept them. If you don't agree, don't use the app.

2. Who may use 4Form AI

You must be at least 13 years old. If you are between 13 and the age of majority where you live, a parent or guardian must read and agree to these Terms with you, and by using the app you confirm they have.

If you are under 13, you may not use 4Form AI.

One account per person. Keep your password to yourself; you're responsible for what happens under your account until you tell us it's compromised.

3. What 4Form AI is

4Form AI measures how your body moves in a training video and gives you technique feedback and drill suggestions based on those measurements.

It is a training aid. It is not a coach, a physiotherapist, or a doctor.

4. What 4Form AI is not (please read this one)

4Form AI does not provide medical advice, diagnosis, or treatment.

The app reports joint positions measured from your video, including readings

it labels as injury-risk indicators. Those are **descriptions of how you

moved**, not predictions, diagnoses, or clinical assessments. A low reading is

not clearance to train, and a high reading is not a finding that anything is

wrong with you.

Always consult a qualified healthcare professional before starting or

changing how you train, and about any pain, injury, or medical condition.

**Never disregard professional medical advice, or delay seeking it, because of

something this app showed you.**

If you are in pain or think you are hurt, stop and see a professional.

If you think you have a medical emergency, call your local emergency number

immediately.

On accuracy

Measurements come from pose tracking of a single 2D video. Accuracy depends on camera angle, lighting, clothing, framing, and how much of you is visible. The app reports its tracking quality and marks what it could not measure. Power and speed, for instance, are shown as "not measured" because they cannot be derived from 2D video. Treat every reading as an estimate.

On AI-generated content

Coaching notes and the AI coach's replies are generated by an AI model. They can be wrong, incomplete, or unsuitable for you specifically. Use your judgement, and your coach's.

5. Your content

Your videos stay on your device. We never receive them. You keep ownership of everything you create.

You grant us a licence to store and process the measurements, text, and messages you send us, for the sole purpose of operating the app for you. That licence ends when you delete the content or your account.

You confirm you have the right to analyse the videos you use, and that any other person visible in them has agreed to it.

6. Acceptable use

Don't: break the law; upload content depicting anyone who hasn't agreed to it; attempt to access another user's account or data; probe, scan, or attack the service; scrape or automate access outside a documented API; reverse-engineer the app; resell it; or use it to build a competing product.

We may suspend or terminate accounts that do these things.

7. Assumption of risk

Physical training carries an inherent risk of injury. That risk exists whether or not you use this app.

You accept that you train at your own risk, that you are responsible for deciding whether any drill is appropriate for you, and that you will stop if something hurts. To the fullest extent the law allows, you release 4Form AI from claims arising out of physical injury sustained while training, including while following a suggestion the app made.

Nothing in this section limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

8. Disclaimers and limits

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that it will be uninterrupted, error-free, or that any measurement is accurate.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill.

Our total liability for any claim is limited to the greater of (a) what you paid us in the 12 months before the claim, or (b) USD 100.

Some jurisdictions don't allow these exclusions, in which case they apply to the maximum extent permitted and the paragraph above about death and personal injury still governs.

9. Subscriptions and payment

Paid plans are billed through the Apple App Store or Google Play, not by us. We never see or store your card details.

• Prices are shown in the app before you buy.
• Subscriptions renew automatically until you cancel.
• Cancel through your App Store or Google Play account settings: cancelling inside 4Form AI changes our record but does not stop store billing.
• Cancelling takes effect at the end of the current period; you keep access until then.
• Refunds are handled by Apple and Google under their policies, not by us, because they took the payment. We'll help you where we can.
• We may change prices with at least 30 days' notice. Changes never apply to a period you've already paid for.

Your statutory rights, including EU/UK withdrawal rights, are not affected.

10. Free plan and limits

The free plan includes a set number of analyses per calendar month, shown in the app. We may change what's in the free plan, with notice.

11. Availability

We may change, suspend, or discontinue any part of the service. If we discontinue a paid feature you're currently paying for, we'll give reasonable notice and a pro-rata refund for the unused period, arranged through the store that billed you.

12. Termination

You may stop using 4Form AI and delete your account at any time, from inside the app.

We may suspend or terminate your account for a breach of these Terms, or if required by law. If we terminate without cause, we'll refund any unused paid period.

Sections 4, 5, 7, 8, 13 and 14 survive termination.

13. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. If you're a consumer, you keep the protection of the mandatory laws of the country you live in.

14. Disputes

Talk to us first. Most problems are solved by writing to support@4formai.com. Please give us 30 days. We'd rather fix it than argue about it.

If we can't resolve it that way, either of us may bring the dispute before any court of competent jurisdiction. If you are a consumer, you keep the right to bring proceedings in the courts of the country where you live.

15. Changes

We may update these Terms. For material changes we'll give notice in the app before they take effect. Continuing to use 4Form AI afterwards means you accept the new version.

16. General

These Terms are the entire agreement between us about the service. If any part is unenforceable, the rest stands. Not enforcing something once doesn't waive it. You may not transfer your rights under these Terms; we may transfer ours in a merger or sale, on notice.
